Terms of Service

By accessing or using the Red White and Give platform (“Platform”), operated by Red White and Give, LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Platform. The Platform is currently available by invitation only. Access requires a valid invitation from an authorized administrator.

To use certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Campaign creators (“Organizers”) may submit campaigns for review. All campaigns are subject to our approval process. We reserve the right to reject, suspend, or remove any campaign at our sole discretion. Organizers represent and warrant that all information provided in their campaigns is truthful, accurate, and not misleading. Campaign funds are intended to be used for the stated purpose.

Donations made through the Platform are voluntary contributions. A platform fee of 18% is applied to public donations to support platform operations. Internal fund donations do not incur fees. Donations are processed through Stripe, our third-party payment processor. All donations are in US Dollars (USD). Refunds may be issued at our discretion in cases of fraud, campaign cancellation, or all-or-nothing campaigns that do not reach their goal.

The Platform charges a service fee on public donations as disclosed at the time of donation. This fee covers payment processing, platform maintenance, and operational costs. The current fee rate is displayed during the checkout process and may be updated from time to time.

Upon campaign completion and settlement approval, funds are disbursed to the Organizer through our manual disbursement process. Disbursement timing is subject to our review and verification procedures. We are not responsible for any delays in disbursement caused by incomplete or inaccurate information provided by the Organizer.

You agree not to:

• ★Use the Platform for any unlawful purpose
• ★Create fraudulent, misleading, or deceptive campaigns
• ★Misuse donated funds for purposes other than stated in the campaign
• ★Attempt to circumvent any security features of the Platform
• ★Harass, abuse, or threaten other users
• ★Submit content that is defamatory, obscene, or infringes on others’ rights
• ★Use automated systems to access the Platform without authorization

The Platform and its original content, features, and functionality are owned by the Company and are protected by copyright, trademark, and other intellectual property laws. Campaign content uploaded by Organizers remains their property, but Organizers grant us a non-exclusive license to display and distribute such content on the Platform.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CAMPAIGN CONTENT. WE DO NOT GUARANTEE THAT CAMPAIGNS WILL REACH THEIR FUNDING GOALS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF FUNDS, DATA, OR BUSINESS OPPORTUNITIES.

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform with a new “Last updated” date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Marion County, Indiana.
